- Knoxxa Digital Ltd – Terms of Service for Starlink Services
This Terms of Service (“Terms”) outlines the agreement between you, the customer ("user"), and Space X Starlink GH LTD (referred to as "Starlink") for Starlink's two-way satellite-based internet service (“Services”) and the Starlink Kit, which includes a Starlink antenna, Wi-Fi router, and mount (“Starlink Kit” or “Kit”). By placing an Order, you agree to these Terms as they apply to Ghana.
1. Deposit
1.1 Applicability
If Starlink Services are currently unavailable in your region, your Deposit Payment will secure priority for Services when available.
1.2 Deposit Payment
Your Deposit Payment includes VAT and will be applied to your Starlink Kit and Services when available. It is fully refundable before shipping.
1.3 Availability and Limitations
The Deposit does not guarantee Services or Kit availability, nor does it secure prices, which may vary by the time of Order. Starlink does not hold Deposits separately and does not offer interest.
2. Agreement to Purchase or Rent the Starlink Kit and Services
2.1 No Resale or Unauthorized Agency
You may not resell access to the Services without Starlink's approval, and resale attempts may result in Service termination.
2.2 Payments for Starlink Kit
For purchasing a Kit, you authorize charges for the Kit, accessories, and associated costs. Title transfers upon delivery for purchased Kits only.
2.3 Payments for Renting a Starlink Kit
- Activation Fee: Due immediately upon Order placement.
- Monthly Rental Fee: Charged from the earlier of activation or 30 days after shipping.
- Retail Penalty: A penalty applies if the Kit is not returned within 30 days of Service cancellation.
2.4 Payments for Monthly Service Subscription
- Monthly Service Fee: Charged upon activation or 30 days post-shipping.
- Additional Data: For some plans, additional charges may apply for data usage beyond limits.
3. Starlink Kit Installation
3.1 Installation Guidelines
You are responsible for Kit installation, and any modifications may void warranties. Starlink is not liable for construction expenses.
3.2 Install Authorizations
You must follow building regulations and obtain any necessary permits and authorizations for Kit installation.
4. Fixed Service Plans
Starlink offers multiple service plans including Residential Lite, Residential, and Priority, each designed to serve different user needs as detailed in the Starlink Specifications and Fair Use Policy.
5. Mobility Service Plans
5.1 Roam Service Plans
The Roam Unlimited and Roam 50GB Plans offer access to Services in designated regions. Starlink may limit services outside these areas.
5.2 Mobile Priority Service Plans
These plans offer priority data for high-demand users, including users requiring global or ocean coverage.
6. Changes, Cancellation, Returns, Transfers, and Termination
6.1 Changes by Starlink
Starlink reserves the right to change service plans, pricing, and terms with notice. Your continued use of Services confirms acceptance of these changes.
6.2 Service Cancellation
Services can be cancelled at any time via your Starlink account, with cancellations effective before the next billing period.
6.3 Kit Return and Refund
Returns are accepted within 30 days for refunds on Kit and initial service fees, subject to Starlink’s return policy.
6.4 Rented Kit Returns
Rented Kits must be returned within 30 days post-cancellation in good condition, or you will be charged the Kit’s retail price.
7. Limited Warranty, Disclaimers, and Liability
7.1 Limited Warranty
Starlink Kits are covered by a limited warranty. All Services and Kits are otherwise provided “as is.”
8. Compliance
Customers must comply with applicable laws, the Starlink Privacy Policy, Acceptable Use Policy, and International Trade Laws.
9. Indemnification
You agree to indemnify Starlink for any claims or damages arising from your violation of these Terms or use of Services.
10. No Unauthorized Transfers
10.1 Transfers and Assignments
You cannot transfer Services or this Agreement without Starlink’s consent. Unauthorized transfers may result in Agreement termination.
11. Governing Law and Disputes
This Agreement is governed by the laws of Ghana for services provided within Earth’s jurisdiction, and by self-governing principles on Mars or in transit to Mars.
12. General Provisions
12.1 Customer Support
Customer support is available on the Starlink Customer Portal. Support calls may be recorded for quality purposes.
12.2 Severability
If any term is deemed invalid, all other terms remain in effect.
12.3 Eligibility
You must be at least 18 years old to enroll in Starlink Services.
12.4 Records
Keep a copy of these Terms for your records, and visit the Starlink Customer Portal for updates.
12.5 Notices and Electronic Delivery
You consent to receive notices electronically via the Starlink Customer Portal or email. Starlink may deliver important updates in these formats.
12.6 No Waiver
A waiver by Starlink must be provided in writing and does not imply a waiver of future breaches.
